The EB-1-3 Visa, also known as the EB-1-C visa, offers permanent residency in the United States to individuals who hold executive or managerial positions in multinational corporations.
EB-1-3 Visa Overview
The EB-1-3 Visa is highly pursued due to its current priority dates, resulting in significantly reduced waiting times compared to other visa categories. One more advantage of the EB-1-3 Visa is that, unlike other work visas, the EB-1-3 does not require the US Department of Labor (DOL) to test the domestic job market to demonstrate the unavailability of qualified US workers for the position.

To qualify for this visa, you must have a solid employment history, having worked outside the US for at least one year within the three years preceding your visa petition. If you are currently employed in the US on a nonimmigrant status, an additional prerequisite is having a minimum of one year of prior employment abroad before commencing work in the US.
Requirements for EB-1-3 visa
To demonstrate international recognition, applicants must satisfy at least two of the following six USCIS requirements:

  1. Major Honors or Prizes: Provide evidence of significant awards or major prizes for outstanding achievements in your academic field.
  2. Membership in Prestigious Organizations: Showcase your affiliation/membership with organizations that require exceptional success.
  3. Academic Writing and Publications: Present proof of published materials about your work through other academic writings and professional publications.
  4. Judging Experience: Participation as an individual or panel judge in the work of others in the same or related academic field.
  5. Innovative Research Contributions: Demonstrate your contribution to innovative scientific or scholarly research in your field.
  6. Authorship of Scholarly Publications: Authorship of scholarly books, publications, or articles in scholarly journals with international circulation in your academic domain.
Although a labor certification is not mandatory, a job offer from a US-based organization is essential. Upon approval, you gain the opportunity to reside, work, and establish permanent roots in the United States. Furthermore, a spouse and unmarried children under the age of 21 are eligible to obtain derivative visas and accompany or join the principal visa holder in the United States.
